The terms governing your access to and use of the Kennisly AI-powered educational platform and related services.

Introduction

Welcome to Kennisly.

These Terms and Conditions ("Terms") govern your access to and use of the Kennisly website, applications, and related services (collectively, the "Service").

By creating an account, accessing, or using Kennisly, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

About Kennisly

Kennisly is an AI-powered educational platform that allows users to upload educational materials and generate learning resources, including:

  • Study notes and summaries
  • Flashcards
  • Quizzes
  • Practice exams and master exams
  • AI-generated podcasts
  • AI tutoring assistance
  • Learning insights and progress tracking
  • Audio and video transcription where supported

Kennisly is intended solely as an educational assistance tool.

Eligibility

You must be at least 13 years old to use Kennisly.

If you are between 13 and 15 years old, you may use Kennisly only with parent or guardian permission where required by applicable law.

Parents and guardians are responsible for supervising use of the Service by minors under their care.

By using Kennisly, you represent and warrant that you satisfy these requirements.

User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Restricting access to your account
  • Ensuring that your account information remains accurate and current
  • All activities conducted through your account

You must immediately notify Kennisly if you suspect unauthorized access to your account.

Kennisly is not responsible for losses resulting from unauthorized use of your account caused by your failure to protect your credentials.

User Content

Users may upload educational content including:

  • PDF documents
  • Presentation slides
  • Notes and text documents
  • Images
  • Audio recordings
  • Video recordings
  • Research materials
  • Educational resources
  • URLs or media links where supported

You retain ownership of your uploaded content.

By uploading content, you grant Kennisly a worldwide, non-exclusive, royalty-free license to:

  • Store content
  • Process content
  • Analyze content
  • Extract text, structure, visuals, audio, and video where supported
  • Generate educational outputs
  • Create embeddings or retrieval indexes needed for search, tutoring, and context retrieval
  • Create backups
  • Maintain, secure, improve, and operate the Service

This license exists solely for the purpose of providing, maintaining, securing, improving, and operating Kennisly.

Privacy of Course Materials

Course Materials uploaded to Kennisly are private by default and are only accessible to the account owner unless functionality is explicitly provided allowing users to share content.

Uploaded materials and generated outputs may be processed by trusted third-party service providers, including AI, transcription, text-to-speech, storage, analytics, authentication, and payment providers, where necessary to deliver the requested functionality.

Such processing is governed by our Privacy Policy and applicable provider agreements.

Support Access to Content

Kennisly staff do not review your Course Materials or generated learning content by default.

If you report an issue, Kennisly may ask for your explicit permission to inspect relevant Course Materials, generated content, tutor messages, podcast outputs, screenshots, logs, or processing metadata for support and troubleshooting.

If permission is granted, access will be limited to the information reasonably needed to investigate the issue.

User Responsibilities

You are solely responsible for all content uploaded or submitted to Kennisly.

You represent and warrant that:

  • You own or have the legal right to upload and process the content
  • Your content does not violate any law
  • Your content does not infringe copyrights, trademarks, privacy rights, or other third-party rights
  • Your content does not contain unlawful, harmful, or malicious material
  • You will not upload sensitive personal data unless you have a lawful basis and all required permissions to do so

Kennisly is not responsible for user-uploaded content.

Artificial Intelligence Services

Kennisly uses artificial intelligence technologies and third-party AI providers to generate educational outputs.

AI-generated outputs may contain:

  • Errors
  • Inaccuracies
  • Hallucinations
  • Misinterpretations
  • Incomplete information
  • Outdated information

Users are responsible for reviewing and verifying all generated content before relying on it.

Kennisly makes no guarantees regarding the accuracy, completeness, reliability, or suitability of AI-generated outputs.

Kennisly does not provide medical, legal, financial, academic, or professional advice.

Educational Disclaimer

Kennisly is an educational assistance platform and not a substitute for professional instruction, academic guidance, or independent study.

Kennisly does not guarantee:

  • Passing examinations
  • Academic success
  • Educational achievements
  • Professional certifications
  • Admissions decisions
  • Employment opportunities
  • Learning outcomes

Users remain responsible for their educational decisions and results.

Third-Party Services

Kennisly may rely on third-party providers, including:

  • Amazon Web Services (AWS)
  • OpenAI
  • AssemblyAI
  • Cartesia
  • Paddle
  • Google Analytics
  • Customer support, monitoring, infrastructure, and security providers where needed

Availability and performance of the Service may depend on such providers.

Kennisly is not responsible for interruptions, failures, delays, inaccuracies, outages, or changes caused by third-party services.

Subscription Plans and Usage Limits

Kennisly may offer free and paid subscription plans.

Unless otherwise stated on the pricing page, the Pro plan includes the following usage limits per subscription cycle:

  • 30 uploads per cycle
  • 5 master exams per cycle
  • 5 podcasts per cycle
  • 50 MB maximum file size per upload

Free plans may have lower limits. Current pricing, plan limits, and included features are displayed on the Kennisly website or inside the Service.

A subscription cycle is based on the user's signup date or subscription billing date, not necessarily a calendar month.

Features, limits, availability, and pricing may change over time. Changes will apply as permitted by law and the terms shown at the time of purchase or renewal.

Billing and Renewals

Paid subscriptions automatically renew unless cancelled before the next billing date.

By purchasing a subscription, you authorize recurring charges using your selected payment method.

Payments are processed by Paddle as payment processor. Paddle may handle payment authorization, VAT or tax calculations, payment records, receipts, invoices, and related billing workflows.

You are responsible for ensuring that your payment information remains valid and up to date.

Failure to successfully process payment may result in suspension or termination of access to paid features.

Refund Policy

Kennisly offers free account creation. Paid subscriptions do not include a free trial unless explicitly stated at checkout.

Except where required by applicable law, all payments are final and non-refundable.

This includes:

  • Subscription fees
  • Renewals
  • Upgrades
  • Additional feature purchases

Partial use, non-use, dissatisfaction, account inactivity, or cancellation does not automatically entitle users to a refund.

Where mandatory consumer protection laws require refunds, those laws will prevail.

Fair Usage Policy

To ensure platform stability and fair access for all users, Kennisly may impose reasonable limits on usage.

Such limits may apply to:

  • File uploads
  • File size
  • Storage usage
  • Processing volume
  • AI tutor requests
  • Podcast generation
  • Quiz generation
  • Exam generation
  • API requests

Kennisly may temporarily restrict or suspend usage that is excessive, abusive, harmful to platform stability, or inconsistent with normal educational use.

Service Availability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

Kennisly does not guarantee:

  • Continuous operation
  • Uninterrupted access
  • Error-free functionality
  • Permanent storage
  • Availability at any specific time
  • Compatibility with all devices or browsers
  • Successful processing of every uploaded file

Users are responsible for maintaining independent backups of important materials.

Prohibited Activities

Users may not:

  • Upload illegal content
  • Upload malicious software
  • Circumvent platform restrictions
  • Attempt unauthorized access
  • Reverse engineer the Service
  • Interfere with platform operations
  • Abuse AI systems
  • Violate intellectual property rights
  • Use the Service for unlawful activities
  • Use the Service to cheat, plagiarize, or violate academic integrity rules
  • Upload content they do not have permission to process

Kennisly reserves the right to investigate suspected violations.

Account Suspension and Termination

Kennisly may suspend, restrict, disable, or terminate accounts where reasonably necessary, including when:

  • These Terms are violated
  • Abuse is detected
  • Fraud is suspected
  • Platform security is threatened
  • Legal obligations require action
  • Excessive or harmful usage occurs
  • Payment fails for a paid subscription

Kennisly may also remove content where reasonably necessary to comply with law, protect users, protect third-party rights, or maintain platform integrity.

Intellectual Property

The Kennisly platform, software, design, branding, trademarks, logos, and technology are owned by Kennisly or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted, users may not copy, distribute, modify, sell, license, or commercially exploit any part of the Service.

Feedback and Feature Requests

Any suggestions, ideas, recommendations, feedback, bug reports, or improvement proposals submitted to Kennisly may be used to operate, troubleshoot, improve, and develop the Service without restriction and without compensation.

Aggregated and Anonymized Data

Kennisly may create and use aggregated, anonymized, and de-identified information derived from user activity and content for purposes including:

  • Improving platform performance
  • Research and analytics
  • Product development
  • Service optimization
  • Understanding feature usage

Such information will not be used to identify individual users.

Limitation of Liability

To the maximum extent permitted by applicable law, Kennisly and its owners, operators, contractors, affiliates, employees, suppliers, and service providers shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Special damages
  • Incidental damages
  • Lost profits
  • Lost revenue
  • Lost opportunities
  • Lost educational outcomes
  • Lost data
  • Business interruption
  • Examination results
  • Academic consequences
  • Decisions made based on generated content
  • Provider outages or third-party service failures

To the maximum extent permitted by law, Kennisly's total aggregate liability arising out of or relating to the Service shall not exceed the total amount paid by the user to Kennisly during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Kennisly and its operators from any claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your content
  • Your use of the Service
  • Your violation of these Terms
  • Your violation of applicable law
  • Your violation of third-party rights

Modifications to the Service

Kennisly may modify, suspend, discontinue, replace, add, or remove features at any time.

Features may evolve as technology and platform capabilities change.

Kennisly shall not be liable for modifications to the Service, except where liability cannot be excluded under applicable law.

Privacy Policy

Use of Kennisly is also governed by the Kennisly Privacy Policy, which forms part of these Terms.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Netherlands.

Nothing in these Terms limits any mandatory consumer rights that cannot be waived under applicable law.

Changes to These Terms

Kennisly may update these Terms from time to time.

Updated versions become effective upon publication on the website unless a later date is stated.

Continued use of the Service after publication constitutes acceptance of the updated Terms.
